RVA DIVA EVENT TOUREN
1. Scope
These General Terms and Conditions apply to all services, rides, events, charter services and voucher offers of Riva Diva Berlin (hereinafter referred to as "provider"). Deviating conditions of the customer do not apply, unless they are confirmed in writing.
2. Subject matter of contract
The provider carries out private boat trips, theme trips, event trips, charter trips as well as gastronomicly accompanied special trips on Berlin and Brandenburg waters. Type, scope, start and end points as well as special services result from the respective service description and the booking confirmation.
3. Booking and conclusion of contract
A booking can be made by e-mail, online form, telephone or in writing.
The contract is concluded with the confirmation of the provider.
The customer is responsible for the accuracy of his information.
Minors are only allowed if accompanied by an adult supervisor.
4. Prices and payment
All prices are in Euro, including VAT.
Payments are due immediately after receipt of the invoice, but at the latest before departure.
On site, cashless payments can only be made (e.g. SumUp, EC/credit card).
Vouchers are valid for 3 years from the date of purchase and cannot be redeemed for cash.
5. Services and changes
Scope and content of the services result from the booking confirmation.
The provider reserves the right to change the procedure for safety or weather-related reasons, provided that these do not significantly affect the overall character of the journey.
Route changes due to traffic conditions, water levels or closures are not a performance deviation.
6. Weather, force majeure, technical failures
Journeys generally take place in any weather, provided that safety is guaranteed.
In the event of a storm, hurricane, closures, technical failures or force majeure, the provider can postpone the trip at short notice or instead offer a new date.
There is no claim for damages.
7. Withdrawal by the customer / Cancellation
Cancellations must be made in writing.
The following cancellation costs apply:
• up to 14 days before appointment: free of charge
• 13–7 days before appointment: 50% of the total price
• from 6 days before appointment or no-show: 100%
Vouchers already redeemed are considered "paid" and will be charged accordingly.
8. Behaviour on board
The instructions of the boatmaster must be followed.
Excessive alcohol consumption, dangerous behavior or non-compliance with safety rules can lead to immediate exclusion from the trip.
The customer is liable for self-inflicted damages.
Shoes with heels or strongly stained soles are undesirable for safety and material protection reasons.
9. Liability
Participation is at your own risk.
The provider is only liable for intent and gross negligence.
No liability is assumed for personal belongings of the customer.
For trips with gastronomic offer, no guarantee is given for food intolerances, unless these have been reported in advance.
10. Data protection
Personal data will be used exclusively for the execution of the contract. A transfer to third parties does not take place, unless this is necessary for the provision of services or is required by law.
11. Photo and video recording
Recordings of the customer will only be published with express consent.
The customer may create private recordings for non-commercial purposes.
VOUCHERS
1. Object
These conditions govern the purchase and use of vouchers of Riva-Diva Berlin, available at riva-diva-berlin.de.
2. Voucher type
The vouchers represent vouchers for a freely selectable amount and can only be redeemed for services of Riva-Diva Berlin. A cash payment is excluded.
3. Period of validity
Vouchers are valid for three years from the end of the calendar year of the date of purchase. After expiry of the validity, redemption is excluded.
4. Redemption
Vouchers can be redeemed as part of the booking by e-mail, telephone or on site. Partial redemptions are possible; remaining amounts remain within the validity period. The vouchers are transferable.
5. Appointment
Redemption is subject to available dates. In addition, the terms and conditions of Riva-Diva Berlin apply to the respective service.
6. Loss and abuse
Riva-Diva Berlin assumes no liability for loss, theft or unauthorized use. A block is only possible if the voucher has not yet been redeemed and the code can be proven.
7. Revocation
There is a 14-day right of withdrawal for vouchers purchased online, if the voucher has not yet been redeemed.
8. Prices
The value of the voucher includes the statutory value added tax. Price changes of the services after voucher purchase have no influence on the voucher value.
9. Liability
The liability of Riva-Diva Berlin is limited to intent and gross negligence as well as to compelling statutory claims.
10. Data protection
The processing of personal data in the context of the voucher order is carried out in accordance with the privacy policy on riva-diva-berlin.de.
11. Applicable law
German law applies. The place of jurisdiction is, as far as legally permissible, Berlin.
If a provision is ineffective, the rest of the contract remains valid.
